Die Grundlagen

What is personal liability insurance for expats?

Privathaftpflicht (Privathaftpflicht, or “Haftpflicht”) covers damage you accidentally cause to other people or their property. It matters more in Germany than almost anywhere else — here you’re liable without an upper limit, so one accident can mean a bill most people couldn’t pay.

For expats, the biggest challenge is understanding the difference between public (GKV) and private (PKV) health insurance. Making the right decision early can save money, avoid coverage gaps and prevent difficult changes later.

Protection when accidents happen

From damaging a rented apartment to injuring someone by accident — personal liability insurance can protect you from claims that could otherwise become very expensive.

Die kurze Antwort

Do expats in Germany need personal liability insurance?

For almost everyone living in Germany, yes. Personal liability insurance (Privathaftpflicht) is not legally required, but you are personally liable — without an upper limit — for damage you accidentally cause to other people or their property. A single serious accident can cost far more than most people could pay.

It costs only a few euros a month, covers your household worldwide on shorter trips, and is the policy German residents take out first. The main decisions are the cover sum and a few key add-ons — which is exactly what a broker checks for you, free of charge.

Who needs personal liability insurance in Germany?

The short version: almost everyone. Because liability in Germany is personal and unlimited, the risk applies whether you rent a small flat or run a busy family household. Open a group below to see why it matters for them:

Tenants

Most landlords in Germany expect new tenants to have personal liability insurance, and many ask for proof before handing over the keys. It covers the everyday risks of renting – a scratched floor, a damaged built-in kitchen, water damage to the flat below – that can otherwise cost thousands to put right.

Children can cause damage no one saw coming, and until a certain age they often can’t be held legally responsible themselves. A family tariff extends the same protection to your partner in the same household and to children living with you, usually for only a little more than a single policy.

You don’t need a permanent address or a long track record to take out cover – protection can start from your first weeks in Germany, and it travels with you on shorter stays abroad. For international students and professionals still settling in, it’s one of the simplest, most affordable pieces of financial security to put in place early.

Warum es zählt

Small premium, potentially unlimited risk

Unlimited personal liability

German law holds you responsible for accidental harm with no upper cap. The insurance is what turns that into a fixed, tiny monthly cost.

Cover sums that actually hold up

Serious injury claims can run into the millions. We steer you toward policies with cover sums that match that reality, not just the lowest premium.

We read the small print

Two policies at the same price can differ hugely on keys, pets, rented property and gross negligence. Comparing conditions is the whole job — and it's free.

Warum es zählt

How much cover do you actually need?

Premiums for personal liability vary a lot between insurers and change over time, so the smarter question isn’t “what does it cost” but “what does it actually cover”. The single most important number is the cover sum (Versicherungssumme) — the maximum the insurer will pay for one claim.

Personal-injury claims can run into the millions, so a low cover sum is a false economy. The difference in premium between a weak and a strong policy is usually small; the difference in protection is not.

€30–50m

A sensible cover sum to aim for. Anything below €10 million is generally too low for the risk it’s meant to carry.

What makes a good policy

Comparing these clauses across insurers is the actual work — and it’s what the free advice is for. As an independent broker we’re paid via commission already included in the premium, so checking the fine print costs you nothing.

Damage to rented or others' property

You scratch the floor or a wall while moving furniture in your flat, or damage something in a friend's home. Repairs are covered.

Lost keys

Lost the key to your building or office? Personal liability typically covers the cost of replacing locks and keys you're responsible for.

Damage caused by small pets

Your cat scratches a landlord's door or a rented sofa. Small-pet damage is usually included — dogs need separate dog liability insurance.

Injuring someone by accident

You collide with another player in a football match. Medical costs and any lost income they suffer can be covered.

What personal liability doesn't cover

Übliche Ausschlüsse, die Sie kennen sollten, bevor Sie sich auf eine Police verlassen.

Broken glass

Windows, glass surfaces and ceramic or induction hobs are typically excluded — that's what glass insurance is for.

Your own property

Damage to your own belongings or home isn't covered — for that you'd look at household contents insurance.

Deliberate acts

Damage you cause intentionally is never covered. Personal liability is for accidents, not on-purpose harm.

Fines and work risks

Legal fines, penalties and anything arising from professional or business activity fall outside a private policy.

Exact inclusions and limits vary by insurer and tariff. Part of the free advice is checking the wording against how you actually live.

Gut zu verstehen

How personal liability insurance works in Germany

The practical details behind the policy — kept short. Open only what’s relevant to you.

How does a personal liability claim actually work?

You report the incident to your insurer, usually with a short description and any photos. The insurer then does two things: it checks whether the claim against you is justified and pays the ones that are – and, just as importantly, it rejects unjustified or inflated claims on your behalf. That second part, sometimes called passive legal protection, is one of the most valuable features of a good policy.

Gross negligence means carelessness that goes beyond an ordinary slip — for example leaving a tap running and flooding the flat below. Basic policies can reduce or refuse payment in these cases. Better tariffs include gross negligence up to the full cover sum, which is exactly the kind of clause worth checking before you sign.

Three kinds of harm are typically covered: damage to someone’s property (you break a friend’s TV), physical injury to another person (a cyclist you didn’t see), and the financial loss that follows from either.

Damage to your own belongings is never part of personal liability – that’s what household contents insurance is for.

Yes. Personal liability follows you through everyday private life – cycling, sport, hobbies and social occasions. Most good policies also include worldwide cover for shorter stays such as holidays, and often for temporary stays abroad up to a defined period. The exact limits vary by insurer, so it’s a detail worth confirming.

The advice, setup and claims support are handled in English. The policy wording itself is often issued in German, as that’s the legal contract language – but we walk you through what it means in plain English before anything is signed, so you always know what you’re agreeing to.

For most people, yes. Cover can start within your first weeks here, costs only a few euros a month, and can usually be cancelled with a short notice period if you leave. Because the risk it protects against – unlimited personal liability – applies from day one, it’s one of the first policies expats tend to arrange.

Personal liability insurance — FAQ

Is personal liability insurance mandatory in Germany?

No, it isn’t required by law for most people. But landlords often expect it, and around 85% of German households have it anyway – because you’re personally liable for accidental damage without an upper limit, and the premium is only a few euros a month.

They’re the same thing. “Third-party liability” and “personal liability” both refer to Privathaftpflicht – cover for damage you cause to other people or their property. It’s separate from household contents insurance, which covers your own belongings.

It’s one of the cheapest policies you’ll own — usually just a few euros a month. Exact premiums vary a lot between insurers and depend on the cover sum and add-ons, so a single fixed figure would be misleading. As an independent broker, we compare the market and find the best conditions for your situation, and the advice is free.

A couple or family tariff can cover your partner in the same household and children living with you, often including dependent parents. It’s usually only marginally more expensive than a single policy, which is why household cover is the common choice.

Most good policies include worldwide cover for shorter stays, such as holidays, and often for temporary stays abroad up to a defined period. The exact limits vary by insurer, so it’s one of the details worth checking before you sign.

No. A private policy only covers private matters. Work- or business-related risks need professional or business liability cover. If you freelance, take a look at our business insurance for freelancers page.

No. As an independent broker, I’m paid by commission from the insurer, which is already built into the premium you’d pay anyway. My advice doesn’t cost you anything extra and doesn’t make the policy more expensive — you simply get an independent comparison.
